Kinmory Terms of Service

1. Acceptance of Terms
By downloading, installing, or using the Kinmory mobile application, KinPad display app, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
These Terms constitute a legally binding agreement between you and Lingxin Artificial Intelligence Technology (Hangzhou) Co., Ltd., the company operating the Kinmory brand ("we," "our," or "us"). You must be at least 13 years of age to use the Services. By using the Services, you represent and warrant that you meet this age requirement.
2. Description of Services
Kinmory is a family memory and AI assistant platform that provides:
- AI-powered text and voice conversation
- Family calendar synchronization and management
- Task management and family rewards system
- Meal planning and grocery list management
- Photo storage and sharing within your family group
- Email AI Listening (AI Plus and Group plans)
- AI image generation (AI Plus and Group plans)
- KinPad family display application
- Memory notes and AI-assisted reminders
Features available to you depend on your subscription plan (Free, AI Plus, or AI Group).
3. Account Registration
3.1 Eligibility
You must be at least 13 years of age to create an account. By registering, you confirm that you are at least 13 years old. If you are adding a child under 13 as a family member, you confirm that you are that child's parent or legal guardian.
3.2 Account Information
You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Family Accounts
One account holder (the "Family Admin") creates and manages the family group. The Family Admin is responsible for:
- Managing family member access and permissions
- Ensuring all family members comply with these Terms
- All charges incurred under the family account
- Managing children's use of the Services in compliance with applicable law
3.4 Account Security
You agree to notify us immediately at [email protected] if you suspect any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account that occurs before you notify us.
4. Subscription Plans and Payments
4.1 Plans
We offer the following subscription plans:

| **AI Group** | All AI Plus features plus expanded storage (50 GB), more family members (up to 8), unlimited KinPad devices, and AI image generation (100/month) |
4.2 Pricing
Current pricing is displayed in the app and at https://www.kinmory.ai. Prices are in USD and are subject to change with notice.
4.3 Billing
- Monthly subscriptions are billed on the same date each month.
- Annual subscriptions are billed once per year and offer a discount compared to monthly billing.
- All payments are processed through Apple App Store. We do not directly handle payment card information.
- Applicable taxes may be added based on your location.
4.4 Free Trial and Promotional Offers
We may offer free trials or promotional pricing from time to time. Trial periods automatically convert to paid subscriptions unless cancelled before the trial ends. Promotional codes and redemption codes are subject to their specific terms and are non-transferable.
4.5 Cancellation
You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.
4.6 Refunds
Apple App Store purchases: Refund requests for subscriptions purchased through the Apple App Store are handled in accordance with Apple's refund policy. To request a refund, contact Apple Support or visit reportaproblem.apple.com.
Stripe (web) purchases: For subscriptions purchased directly through our website via Stripe, the following refund policy applies:
- Annual subscriptions: If you cancel within 14 days of your initial purchase or annual renewal and have not made significant use of paid features during that period, you may request a full refund by contacting [email protected].
- Monthly subscriptions: Monthly subscription fees are non-refundable once the billing period has begun. You may cancel at any time to prevent future charges.
- Exceptions: We may issue refunds at our discretion in cases of technical failures that prevented access to the Services for an extended period, or as required by applicable consumer protection law.
To request a Stripe refund, email [email protected] with the subject line "Refund Request" and include your registered email address and the reason for your request. We will respond within 5 business days.
4.7 Plan Changes
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period. If you downgrade, you may lose access to features and data associated with the higher plan tier.
5. Acceptable Use
5.1 Permitted Use
You may use the Services only for lawful, personal, and family purposes in accordance with these Terms.
5.2 Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws or regulations
- Upload, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
- Upload content that infringes any third party's intellectual property rights, privacy rights, or other legal rights
- Attempt to gain unauthorized access to any part of the Services, other user accounts, or our systems
- Use the Services to send spam, unsolicited messages, or automated requests
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services
- Use the Services to develop a competing product or service
- Scrape, crawl, or use automated tools to extract data from the Services
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Services
5.3 Content Standards
Content you upload or share through the Services (including photos, notes, and messages) must not:
- Depict or promote child sexual abuse material (CSAM) — we will report any such content to the National Center for Missing and Exploited Children (NCMEC) and law enforcement
- Contain malware, viruses, or other harmful code
- Violate any third party's privacy or intellectual property rights
5.4 Enforcement
We reserve the right to remove content that violates these Terms, suspend or terminate accounts, and report illegal activity to law enforcement, without prior notice.
6. Your Content
6.1 Ownership
You retain ownership of all content you upload, create, or share through the Services ("Your Content"), including photos, notes, calendar events, and messages.
6.2 License to Us
By uploading Your Content to the Services, you grant us a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Services to you. We do not claim ownership of Your Content and do not use it for any purpose other than operating the Services.
6.3 AI Processing
When you use AI features (text chat, email analysis, photo chat, image generation), Your Content is processed by our AI systems and third-party AI providers (Google Gemini) as described in our Privacy Policy. This processing is performed solely to provide the AI features you request.
6.4 Responsibility for Content
You are solely responsible for Your Content and the consequences of sharing it. We do not endorse, verify, or take responsibility for any content uploaded by users.
6.5 Content Backup
We are not a backup service. We recommend maintaining your own copies of important content. We are not liable for loss of Your Content due to technical failures, account termination, or other causes.
7. Intellectual Property
7.1 Our Intellectual Property
The Services, including the app design, software, AI models, logos, trademarks, and all content created by us, are owned by Kinmory and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our intellectual property without our written permission.
7.2 Feedback
If you provide us with feedback, suggestions, or ideas about the Services, you grant us the right to use that feedback without compensation or attribution to you.
8. Third-Party Services and Integrations
8.1 Third-Party Integrations
The Services integrate with third-party services including Google Calendar, Apple Calendar, Outlook Calendar, Gmail, Outlook Mail, Apple Mail, Instacart, and others. Your use of these integrations is subject to the respective third-party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
8.2 Third-Party AI Providers
Our AI features are powered by Google Gemini. By using AI features, you acknowledge that your inputs may be processed by Google's systems in accordance with Google's terms and privacy policies.
8.3 App Store
Your download and use of the Kinmory app is also subject to Apple's App Store Terms and Conditions.
9. Privacy
Your use of the Services is subject to our Privacy Policy, available at https://www.kinmory.ai/privacy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection and use of your information as described in the Privacy Policy.
10. Disclaimers
10.1 "As Is" Service
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
10.2 AI Accuracy
AI-generated content, including calendar event suggestions, task recommendations, email analysis results, and image generation outputs, may contain errors or inaccuracies. You should review all AI-generated content before acting on it. We are not liable for decisions you make based on AI-generated content.
10.3 Service Availability
We do not guarantee that the Services will be available at all times. We may suspend or discontinue the Services or any feature at any time, with or without notice, for maintenance, updates, or other reasons.
10.4 Third-Party Content
We are not responsible for the accuracy, completeness, or legality of content provided by third-party integrations (e.g., calendar events synced from Google Calendar).
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KINMORY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA
ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Kinmory and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your Content
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
13. Termination
13.1 Termination by You
You may terminate your account at any time by deleting your account in the app or by contacting us at [email protected]. Termination does not entitle you to a refund of any prepaid fees.
13.2 Termination by Us
We may suspend or terminate your account and access to the Services at any time, with or without cause, with or without notice, including if we believe you have violated these Terms. We will provide notice where reasonably practicable.
13.3 Effect of Termination
Upon termination:
- Your right to use the Services immediately ceases
- We will delete your data within 30 days, except where retention is required by law
- Provisions of these Terms that by their nature should survive termination will survive, including Sections 6, 7, 10, 11, 12, and 15
14. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will:
- Update the "Last Updated" date at the top of these Terms
- Send an email notification to your registered email address
- Send an in-app push notification
Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and delete your account.
15. Governing Law and Dispute Resolution
15.1 Governing Law
These Terms are governed by applicable law. *(This section will be updated upon completion of our corporate registration. We are in the process of determining the appropriate jurisdiction.)*
15.2 Informal Resolution
Before filing a formal legal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.
15.3 Dispute Resolution
If informal resolution fails, disputes arising out of or related to these Terms or the Services will be resolved through binding arbitration conducted in English. *(The specific arbitration body and rules will be specified upon completion of our corporate registration.)*
Exception: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
15.4 Class Action Waiver
YOU AND KINMORY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
15.5 Users Outside the United States
If you are located in Canada, Australia, or New Zealand, local consumer protection laws may provide you with rights that cannot be waived by contract. Nothing in these Terms limits rights you have under applicable local law.
In particular:
- Australian users: Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot lawfully be excluded or limited.
- Canadian users: These Terms are subject to applicable provincial consumer protection legislation.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kinmory regarding the Services and supersede all prior agreements.
16.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
16.5 Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, acts of government, internet outages, or third-party service failures.
